You can now register for services provided by our ESF instructors at Barèges either via our website, by telephone, by fax or by any other method of distance communication.

For online sales via our website, just follow the online registration instructions and your order will be transmitted electronically to the ESF Barèges.

For other types of distance purchase, please contact ESF Barèges.

Registration for ESF Barèges services implies total acceptance of these general terms and conditions. plan national et international.

CLAUSE 1 – SERVICES

All ESF instructors at Barèges have undertaken state-accredited training and their teaching methods are recognised both nationally and internationally.


Services are provided for both individuals and groups. In order for lessons to be successful, the competence level of all skiers participating in them must be of a similar standard. Given that it would be impossible from a practical point of view for ESF instructors at Barèges to assess the standard of each pupil prior to registration, the latter will be solely responsible for the technical choice that he/she makes in accordance with the table drawn up by ESF Barèges.

Consequently, ESF Barèges reserves the right to move a skier from one group to another that is more suitable for his/her level, if this does correspond to that previously stated. This is, however, subject to there being other suitable groups available. In this respect, the skier in question will not be able to claim any reimbursement or any other type of compensation with regards to his/her statement of level.

Learning to ski will take place in a specific but random environment. The pupil will be personally liable for his/her own safety and also for that of any third parties. The instructor’s liability will be limited to an obligation of best effort in facilitating skiing lessons. It is the responsibility of the pupil to follow the instructor’s recommendations and advice. The pupil will be solely liable for his own equipment.

ESF Barèges may not be held liable for any accidents caused by any of the skiers participating in the lesson.

INSURANCE

The ESF has insurance through a Professional Indemnity Policy that covers their instructors when performing their duties against any damage caused to third parties as well as covering their clients whilst they are under the authority of the ESF and the instructor.
The client and/or the pupil is/are solely liable for his/her own equipment. The instructors cannot be held liable for any damage caused by the said equipment or for the theft or deterioration of it.


CLAUSE 2 – RATES / REGISTRATION / PAYMENT

Rates

ESF Barèges rates are displayed on the online sales website, and can be viewed on esf.net as well as on the specific ESF Barèges website.
Prices quoted include tuition services provided by an ESF Barèges instructor but do not include any other service (insurance, ski lifts, accommodation, etc.), unless otherwise stated. Therefore, prior to the lesson commencing, the pupil must obtain a pass in order to have access to the ski lifts and must also take out his/her own insurance which should provide cover against any of the risks inherent to a sporting activity taking place in a mountain environment (public liability cover, emergency cover, etc.).

Registration and payment

You must complete the registration procedure on this website. After your online payment is made, your booking will be transferred to the ESF Barèges; the school will immediately send you an email to acknowledge receipt of your order.

Payment is made in full when your reservation is sent via the ESF Barèges online sales website. This payment formalizes the contract and receipt thereof will be confirmed by email.
A single way of registering and paying for our services is available: Cyberplus (Banque Populaire’s electronic bank) sends your booking form and bank transfer via the Internet to ESF Barèges, so your payment is certified, secure and guaranteed by the banking system.
ESF Barèges will ensure the availability of its lessons once the contract has been entered.

Services are booked for set dates.


For other types of distance sales:

Registration can be made by sending a booking form together with the full amount due by cheque, bank card, etc., to ESF Barèges.

ESF Barèges will only ensure the availability of lessons for which a contract has been entered.

Payment formalizes the contract.

Services are booked for set dates. As such, the retraction deadline of 7 days for distance selling provided for in Article L121-20 of the French Consumer Code is not applicable pursuant to Article L121-20-4 of the same code.


CLAUSE 3 – REQUEST FOR VALUE OF MEDAL TO BE REIMBURSED

Only valid if an ALL-INCLUSIVE option has been purchased: Ski lessons + medal.

If you have purchased an ALL-INCLUSIVE option (ski lessons + medal) and you do not require the medal: it is possible to be reimbursed by the amount of the medal’s retail price by requesting this at the ESF booking office at any time during the period that the lessons are ongoing. After the last lesson, no reimbursement will be possible.

ESF Barèges only sells the ‘lessons + medal’ option for group lessons in downhill skiing and snowboarding.



CLAUSE 4: – CANCELLATION OF THE BOOKING OR WITHDRAWAL FROM THE LESSONS BY THE CLIENT

ESF offers clients cancellation insurance (see appendix). Each client is free to take out this insurance policy or not. However, ESF Barèges will not make any reimbursements for services for any incident that falls with the scope of the proposed guarantees, regardless of whether the client has taken out insurance or not.


CLAUSE 5: – CANCELLATION / WITHDRAWAL FROM THE LESSONS / EXCLUSION OF CLIENTS BY THE ESF .

ESF Barèges reserves the right to cancel lessons before they are due to begin or after they have begun particularly in the event of force majeure.
Force majeure principally comprises an event involving: closure of the ski slopes or the ski lifts, weather conditions which are dangerous with regards to access to the skiing areas.
ESF Barèges reserves the right to exclude, at any time, a client whose behaviour is such that it disrupts the smooth running of the lessons. Should this occur, the client will not be able to claim any reimbursement.


CLAUSE 6 – RESOLUTION OF DISPUTES

The parties shall make every effort to amicably resolve any problems that may occur during the performance of the contract. Should this prove to be impossible, any disputes relating to the validity, interpretation and/or performance of this contract shall be exclusively governed by French law.
All litigation, regardless of its nature and including any summary proceedings, shall be subject to French civil and commercial jurisdiction.
